§1 Scope of application of the Regulations

1. The Regulations apply to all Reservations/Purchases made via the website www. https://goingapp.pl/.

2. Making a Reservation / Purchase is tantamount to acceptance of the Regulations.

3. The customer confirms that he has read the Regulations when he purchases a ticket.

4. In the case of a Customer who is a natural person, by making a transaction, the Customer consents to the processing of his personal data to the extent necessary to make a purchase, in particular to making the data available to the Organizer of the Event for which the Purchase is made.

§ 2 Ticket purchase process

1. In order to make a Reservation and purchase Tickets, the Customer:

a) selects the Event from the list available on the Website,

b) selects places/sectors from those available for a given Event,

c) provides his data, i.e. name and surname, e-mail address and contact telephone number,

d) confirms having read the Regulations by purchasing Tickets,

f) in the case of Ticket Forms, provide the full delivery address, i.e. street, house number, apartment number, postal code and city,

g) chooses the payment method from the list available on the Website.

2. Before confirming the Reservation/Purchase, the Customer sees on the Website its summary with the specified amount to be paid.

3. The customer accepts the terms of the PURCHASE by clicking the "buy ticket" button.

4. The customer is responsible for the veracity and correctness of the data referred to in section 1.

5. The reservation is temporary and valid for the time indicated in § 5, which results from the selected form of payment.

6. The Organizer of the Event sends to the Customer's e-mail address indicated in accordance with sec. 1 lit. c) a summary of the Reservation.

7. The customer pays the amount resulting from the Reservation/Purchase in accordance with the payment method of his choice.

8. After receiving the full amount resulting from the Booking/Purchase, the Event Organizer delivers the Tickets to the Customer in accordance with § 5.

§ 3 Form of Tickets

1. Tickets for Events sold on the website are available only in the form of PDF tickets.

2. In the case of a PDF Ticket, the Customer undertakes to keep secret the booking number, the self-set password necessary for printing and not to make the file or printout of the PDF Ticket available to third parties, thus undertakes to protect the electronic ticket against any attempts to copy, scan and duplicate .

§ 4 Forms of payment and validity of the Reservation

1. The Organizer of the Event offers the following payment methods for Tickets:

a) Internet payment (on-line) by bank transfer or payment card.

2. Available forms of payment for a given Event from those specified in section 1 are provided while making the Purchase.

3. The Customer selects the form of delivery of the Tickets in accordance with § 2 sec. 1 lit. e).

4. Internet (on-line) payments are made by an entity cooperating with the Event Organizer, providing services for accepting payments by payment cards and/or online transfers.

5. The name of the entity/entities cooperating with the Event Organizer, referred to above, is available on the Website and is visible to the Customer during the Ticket purchase process.

6. The choice of the payment method by the Customer determines the receipt of tickets.

7. The conclusion of the contract with the Customer takes place at the time of payment of the full amount due resulting from the purchase of tickets.

8. If the bank transfer option is selected, the payment may be made only to the bank account number indicated in the Booking confirmation sent to the Customer's e-mail address.

9. The Organizer of the Event accepts transfers in PLN.

10. If the Customer transfers funds in connection with the Reservation in a manner other than specified in section 12, the Event Organizer will return them to the account of the sender-Client, deducting the cost of such payment charged by the Organiser's bank from the transfer amount.

11. The customer agrees to deliver sales invoices by e-mail to the e-mail address indicated in the order.

§5 Forms and conditions of delivery of Tickets and Goods

1. The following forms of delivery are available:

a) for PDF Tickets: by e-mail to the e-mail address indicated by the Customer in accordance with § 2 sec. 1 lit. c).

2. VIP invitations are delivered only on the territory of the Republic of Poland.

3. The available forms of delivering Tickets are available in the Regulations.

4. The Customer selects the form of delivery of the Tickets in accordance with § 2 sec. 1 lit. e).

5. Delivery dates, subject to sec. 6 are as follows:

a) in the case of Ticket Blanks delivered via a postal operator: a minimum of 3 and a maximum of 14 business days,

b) in the case of PDF Tickets delivered by e-mail: maximum 1 business day

6. If a reservation has been added in the description of the Event that the Tickets are not delivered before a specific date, the dates referred to above are counted from that date.

7. In the case of PDF Tickets, the Event Organizer sends them to the e-mail address by electronic means, a link to the Portal indicated by the Customer, enabling them to be downloaded, saved and printed.

8. After receiving the Tickets, the Customer is obliged to check the correctness of the data printed on the Tickets with the data provided during the Booking in accordance with § 2.

9. Any discrepancies identified by the Customer during the verification referred to above should be reported to the Event Organiser.

10. In the case of purchasing Tickets for several people, a third party whose data is not assigned to the Ticket in a way that allows their verification is entitled to enter the Event area only at the same time as the Ticket holder whose data is assigned to the Ticket. In the case referred to above, the Ticket holder whose data is assigned to the Ticket is also obliged to enter the Event area together with other persons who presented/scanned the Tickets in his presence. The Organizer reserves the right to charge a fee for changing the data on the Ticket.

11. If a disabled person wants to participate in the Event together with a guardian, each of these persons is obliged to purchase Tickets.

 

§ 6 Canceled Events and Returns

 

1. Return or exchange of Tickets is possible only in the event of cancellation of the Event, significant change of the venue or date of the Event. In such a case, the Organizer informs each time about the possibility and dates of returning the Tickets. The return or exchange of Tickets related to cancellation or change is possible no later than before its scheduled date, or on the appointed date. Three weeks before the start of the Event, it is only possible to initiate a complaint procedure, regardless of whether the admission ticket has been used. Tickets during this period are non-refundable as this is the time defined as the protected event period.

If the event date is changed, the tickets are automatically moved to the new date without the need to inform the Organizer. In this case, it is also possible to return the ticket in accordance with the procedure that was sent when purchasing it at the ticket office. The refund is made within 30 days from the date of information about the transfer of the event. If you have any additional questions, please send inquiries to: tickets@kpopstarsfestival.com

2. Tickets are sold only on the websites www.empik.pl, www.goingapp.pl and at authorized points of sale (Empik stores). A handling fee may be added to the price printed on the ticket, depending on the fees applicable in individual ticket sales channels. The organizer is not responsible for Tickets purchased at unauthorized points of sale, which are provided by the organizer in the official announcement of the event.

3. In justified cases, in particular for technical or production reasons, the organizer has the right to return the ticket or change the originally ordered seats to other ones, both before and during the event.

4. In cases other than those described in point 1 Ticket returns are not possible - the Customer has no right to withdraw from the contract regarding the Organization of Outdoor Events three weeks before its organization. Please think carefully before purchasing, as the Organizer does not accept returns in other cases.

5. In the case of consumers, the restriction referred to in par. 2 results from art. 38 point 12 of the Act.

6. In the cases referred to in par. 1 The Organizer shall refund the amount due to the Customer immediately, no later than within 60 working days, in the same way as the Customer paid for the Tickets.

7. We treat the Outdoor Event as an entertainment event, so Article 38 of the Act on Consumer Rights applies, taking into account the catalog of exclusions from the right to withdraw from a contract concluded off-premises or remotely. Point 12 of the said provision says about: the provision of services in the field of accommodation, other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, provided that the day or period of service provision is indicated in the contract. Thus, the Customer has no right to return the ticket. Changes in the composition of the bands (the form of the festival makes it better), the duration of the event are not a reason that can be considered a complaint, so they do not constitute grounds for returning tickets,

 

§ 7 Complaints

 

1. All customer complaints are considered by the Event Organizer within a maximum of 30 business days and should be sent to the e-mail address with information about the reasons for the complaint and a description of the complaint, otherwise the complaint will be rejected.

 

 

§ 8 Other provisions

 

1. The Organizer of the Event is not liable for damage caused by the actions or omissions of the Customer or other persons, in particular for their use of the Website in a manner inconsistent with applicable law or the Regulations.

2. A ticket that is illegible, destroyed or damaged does not entitle the Customer to enter the Event.

3. The above regulations apply to the purchase of all tickets issued by the Organizer for its Events.

4. The purchase of tickets confirms that you have read the rules of purchasing tickets. Each ticket buyer confirms that he has read the regulations and that he has accepted them.

 

 

In the case of purchasing three-day passes, the ticket entitles you to use the entrances / exits in each city on the day after presenting your ID card. Minors (under 16 years of age are registered with the data of a parent or guardian)
